NOTICE OF CITY OF OVIEDO, FLORIDA
REFERENDUM ELECTION
PROPOSING CITY CHARTER AMENDMENT
RELATING TO ACQUISITION OF ALAFAYA UTILITIES, INC.
TO BE HELD ON AUGUST 24, 2010
To be held on Tuesday, August 24, 2010, as provided by Ordinance No. 1492 of the City Council, as governing body of the City of Oviedo, Florida enacted on June 7, 2010.
Pursuant to Section 100.342, Florida Statutes, NOTICE IS HEREBY GIVEN by the City of Oviedo, Florida that a referendum election which will be held Tuesday, August 24, 2010 for the purpose of considering approval of an amendment to Section 4.08.11 of the City of Oviedo City Charter which amendment provides for funding the purchase of the wastewater and reclaimed water assets and systems of Alafaya Utilities, Inc.
The referendum election will be held to determine whether to amend Section 4.08.11 of the City of Oviedo City Charter to provide for the purchase the wastewater and reclaimed water assets and systems of Alafaya Utilities, Inc. in order for the City to issue bonds not exceeding $36,000,000 and bearing interest not exceeding maximum legal rates payable from the City's utility systems net revenues to acquire and improve such utility systems, and to provide reserves and pay acquisition and bond issuance costs.
The issuance of such bonds and the holding of such referendum election have been authorized by
Ordinance No. 1492 of the City Council of the City enacted on June 7, 2010. In accordance with the Constitution and laws of the State of Florida, all qualified electors of the City of Oviedo, Florida, shall be entitled to vote in the referendum election to which this notice pertains. The polls at said referendum election will be open from 7 a.m. until 7 p.m. on August 24, 2010 and will be held at polling places in the precincts of the City.
The City of Oviedo shall be authorized to issue the bonds referenced above only if the proposed amendment to the City of Oviedo City Charter is approved by vote of a majority of the qualified electors of the City of Oviedo voting thereon.
Absentee ballots for this referendum election are available through the Seminole County Supervisor of Elections Office by calling 407-708-7700. Early voting will occur in accordance with the controlling provisions of State law.
