CITY OF OVIEDO, FLORIDA

OFFICE OF THE CITY MANAGER 

EMERGENCY MANAGEMENT – COVID-19 - EXECUTIVE ORDER 2020-002 

LOCAL GOVERNMENT PUBLIC MEETINGS


WHEREAS, Governor Ron DeSantis issued Executive Order 20-51, declaring that appropriate measures to control the spread of COVID-19 in the State of Florida are necessary, and therein directed that a Public Health Emergency be declared in the State of Florida; and

WHEREAS, on March 11, 2020, the Mayor of the City of Oviedo, Florida (the “City”) issued a Proclamation pursuant to the provisions of Chapter 20, Section 20-4(1) of the Code of Ordinances of the City of Oviedo declaring a state of local emergency pertaining to all territory within the legal boundaries and jurisdictional limits of the City of Oviedo; and

WHEREAS, as a result of the Public Health Emergency Declaration many local governments and municipalities have been prevented from taking actions at meetings that would normally have occurred but for the declared Emergency; and

WHEREAS, Governor Ron DeSantis has issued Executive Order 20-69 that amends or modifies the provisions of Section 120.54 (5)(b)2, Florida Statutes to provide that attendance at public meetings, hearings and workshop may be by means of communications media technology; and

WHEREAS, on April 1, 2020, I, Bryan Cobb, City Manager of the City of Oviedo, issued Emergency Management – COVID-19 – Executive Order 2020-001 implementing the procedures to be used for the conduct of public meeting, hearing or workshops of the City Council of the City of Oviedo and any meeting authorized by such City Council; and

WHEREAS, I, Bryan Cobb, City Manager of the City of Oviedo, have determined that it is necessary to amend or modify City of Oviedo Emergency Management – COVID-19 – Executive Order 2020-001 to add another provision to the procedures implemented by such Executive Order 2020-001 that provides for the option of any City Council Member to attend a public meeting, hearing or workshop remotely by communications media technological means as provided for in Executive Order 20-69 issued by Governor Ron DeSantis. 

NOW, THEREFORE, I, Bryan Cobb, City Manager of the City of Oviedo, by virtue of the authority vested in me pursuant to all applicable Executive Orders, and City of Oviedo Code of Ordinances Chapter 20, Section 20-4(4) do hereby adopt and issue the following Executive Order to take immediate effect:

Section 1.

Section (b) (10) is added to Executive Order 2020-001 as follows:  If, due to a Declared Public Health Emergency, a City Council Member elects to attend a public meeting, hearing or workshop by means of communications media technology, he/she shall be permitted to do so and he./she shall be permitted to attend by means of telephonic communications or other technological means, by either audio or audio/video and/or internet access and such City Council Member electing to attend by communications media technological means shall be permitted to participate in and vote on all matter discussed or addressed at such meeting, hearing, or workshop and his/her attendance by communications media technological means shall be  included when determining whether or not a quorum is legally present as provided for in Executive Order 20-69 issued by Governor Ron DeSantis.

Section 2. 

Except as amended or modified herein, Executive Order 2020-001 is ratified and reaffirmed.
